This Customer Acceptance Policy (CAP) is established by Dialer Guru to comply with the legal and regulatory frameworks governing telecommunication services in the United States. The CAP outlines the mandatory Know Your Customer (KYC) procedures and acceptance criteria to ensure the ethical and lawful use of our dialer services. It is designed to prevent the utilization of our services for unauthorized activities, including the prohibition of processing raw data.

  1. Legal and Regulatory Framework

Dialer Guru operates under strict adherence to U.S. telecommunications laws, including the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), and relevant data protection regulations. This CAP is crafted to align with these legal requirements, ensuring both Dialer Guru and its clients operate within the bounds of the law.

  • Customer Due Diligence (CDD)
  • 2.1 Identification and Verification: Customers may be asked to provide comprehensive business documentation, including but not limited to, incorporation certificates, business licenses, and principal’s identification. These documents will be scrutinized for authenticity through independent sources.
  • 2.2 Risk Assessment: A thorough risk assessment will be conducted for each customer, evaluating the potential for legal non-compliance and the nature of intended service use.
  • 2.3 Beneficial Ownership: In accordance with anti-money laundering (AML) regulations, Dialer Guru will identify and verify the identity of beneficial owners holding a significant control or ownership interest in the client entity.
  • Acceptance Criteria

Customers must demonstrate a legitimate need for dialer services and must not engage in activities that could contravene U.S. laws or regulations. Specific criteria include:

  • Legality of business operations and alignment with permissible telecommunication practices.
  • Absence of previous or current engagement in unlawful or unethical activities, including data misuse.
  • Agreement to Dialer Guru’s terms of service, prohibiting the use of services for illegal activities, including the processing or dissemination of raw data.
  • Rejection and Termination Policies
  • 4.1 Rejection of Application: Dialer Guru reserves the right to reject any application that does not meet the KYC or risk assessment standards, or if the applicant is found to have intentions contrary to the lawful use of services.
  • 4.2 Termination of Services: Services may be terminated for existing customers who violate legal requirements, this CAP, or engage in prohibited activities.
  • Compliance Monitoring and Review
  • 5.1 Ongoing Monitoring: Continuous monitoring of customer accounts and transactions will be conducted to detect and prevent illegal activities.
  • 5.2 Regular Review: The CAP will be reviewed annually or in response to regulatory changes, to ensure its effectiveness and relevance.
  • Record Keeping and Reporting

Detailed records of customer identification, verification, and transactional activities will be maintained for a period as mandated by law, to support audit processes and regulatory inspections.

  • Training and Compliance Awareness

Dialer Guru will implement an ongoing training program to ensure that all employees are knowledgeable about the CAP, KYC processes, and the importance of compliance with regulatory standards.

  • Enforcement and Disciplinary Actions

Violations of this CAP by employees or customers will result in appropriate disciplinary actions, which may include service termination, legal actions, and reporting to regulatory bodies.

  • Amendments

This CAP is subject to amendment to reflect changes in legal, regulatory, and operational requirements. Stakeholders will be notified of any significant changes to the policy.

This CAP is to be read in conjunction with Dialer Guru’s Acceptable Use Policy and Legal SOPs, and it is binding on all customers as part of their service agreement with Dialer Guru.
